Statutory regulations for the scattering of ash in Germany

In Germany, the so-called Friedhofszwang, which states that the remains of a deceased person may only be buried in an official cemetery or in certain exceptions regulated by law. That means:

  • The unauthorised scattering of ashes is generally prohibited.
  • Storing an urn at Hause is also not allowed.
  • However, there are a few federal states with special regulations.

Exceptions in individual federal states

Some federal states have partially relaxed the cemetery requirement and allow the ashes to be scattered on certain areas:

  • berlin: Ash scattering on designated litter fields in cemeteries is possible.
  • brandenburg: Allows the ashes to be scattered under certain conditions.
  • Mecklenburg-Western Pomerania: Approval of ash scattering on approved areas.
  • North Rhine Westphalia and thuringia: Individual cemeteries offer litter fields for anonymous ash distribution.
  • bremen: There is a special rule here which allows ashes to be scattered on private property or in public places, provided that there is a written order from the deceased.

Ash distribution abroad — What are the options?

Since Germany does not offer the option of free ash distribution in many cases, many people opt for burial abroad. Some countries with more liberal funeral laws include:

  • switzerland: The ash may be scattered in the Alps, rivers or meadows.
  • netherlands: Here is the option to scatter ash at a location of choice after a waiting period of four weeks.
  • Spain and France: Allow ash to disperse in specific locations.
  • Czechia: No strict burial laws, so spreading the ashes is legal.

Alternative forms of burial when ash dispersal is not possible

If ash scattering is out of the question, there are alternative types of burial that enable a natural and individual memory:

  1. Burial at sea: The urn is buried on the high seas, often with a ceremony.
  2. Forest burial: The ashes are buried at the roots of a tree in Friedwald.
  3. diamond burial: Some of the ashes are pressed into a memorial diamond.
  4. Alpine meadow burial (Switzerland): The ashes are scattered in the mountains.
  5. air burial: The ashes from an airplane are scattered in nature (possible in France or the Netherlands, for example).

Ash dispersal process — What must be considered?

If legal ash distribution is to take place in Germany or abroad, a few steps are necessary:

  1. Deposit a funeral order: The deceased person should record his wish to scatter ash during his lifetime.
  2. Obtain approvals: In Germany, only possible on designated areas. Country regulations must be observed abroad.
  3. Hire an undertaker:As an experienced funeral home, we take care of the organization.
  4. Carry out ash dispersal: Depending on the country and type of burial, the distribution is carried out with a ceremony or quietly in a small circle.

In Germany, the scattering of ashes is only allowed under certain conditions in individual federal states. If you want a free spread of ash, you often have to switch abroad. Alternatively, there are forms of burial close to nature, such as sea burial or forest burial.
